The Failure of the 28-Clause Ceasefire Plan for Ukraine: Why Diplomatic Efforts Continue to Falter

Europe experienced widespread relief on Monday, as the diplomatic emergency triggered by the announcement of a new 28-point plan for achieving ceasefire appeared – briefly – to have been defused. A Washington representative spoke of "significant advancement" after diplomatic discussions in Geneva. On Monday night, the Kremlin made its countermove: an extensive attack of rocket attacks on Kyiv.

The Pattern of Negotiation and Warfare

The succession of opposing developments captured the harsh reality of the current period. By day, negotiation efforts are conducted: positive announcements are issued from multiple capitals. Considerable effort is devoted on restraining certain initiatives. By night, the Kremlin clearly shows the world that, for them, conflict continues to be the primary tool for achieving "settlement".

Nighttime Reality

As military strikes unfolded into the early hours of Tuesday, the immediate reality of Ukraine's defenselessness was exposed. Ukraine is equipped to monitor missile launches from enemy soil, a capacity afforded by current data. From witness perspectives, Ukrainian air force fighter jets that had been dispatched to counter approaching guided weapons flew past – advanced fighter aircraft provided to Ukraine by Western partners.

Moments later, Kyiv's air-defence systems activated: defensive missiles fired to intercept a Russian ballistic missile. This was a sophisticated defense system at work, presumably supplied through allied countries. Every launch creates sudden vibrations, shaking the windows. The instant of fear quickly becomes sober acceptance: perhaps the hostile projectile won't hit its mark this time, sparing the city from ruin and additional electricity failures.

Persistent Threats

Following this, a heavy machine gun fired at a aerial vehicle somewhere nearby, part of a mobile-fire group – probably imported technology. Sadly, the shots failed to hit the enemy aircraft – it maintained course toward its destination.

Intermittently, this carried on until dawn. Kyiv faced the morning news: several casualties, damage and heating outages in multiple buildings as a result of the night's assault. As always, everyone still maintained normal activities – living the war. But those 24 hours encapsulated Ukraine's essential dependence on Western support – a reliance that neighboring countries are evidently unprepared to fill in the near term.

Unsuccessful Negotiations

The detailed framework from US administration provoked deep reactions, controversy and deep concern – and temporarily diverted attention from Ukraine's major integrity crisis in years. Yet, we have witnessed similar scenarios, after earlier high-level meetings and multilateral gatherings.

Every new approach from Washington follows the same pattern: a negotiation push against Ukraine, which Kyiv, with partner nations, manages to fend off. They manage the tension but never actually achieve victory. This pattern will, undoubtedly, continue.

Tactical Assessments

It is easy to blame specific actors of repeatedly advocating Russian terms. But that does not seem to be the whole story. Washington works based on a principle familiar among experienced diplomats: you cannot secure via talks what you have failed to defend militarily. The US administration presumes that it is impossible to force Russia to abandon the areas that it already controls in Ukraine's southern or eastern regions.

The problem is that while accepting these circumstances, Washington does nothing to deter Moscow, through words or deeds, from thinking that the current condition will not shift further in its favour in the months ahead.

Divergent Views

Therefore, Moscow is confident that duration works to their advantage – that Ukraine and its allies are coming close to fatigue. Their motivation to sign a deal that does not give them the maximum possible gain is close to zero. There may be many attempts to stop fighting, but they will carry on as long as Russia's leadership remains supremely confident in the conclusion.

On the contrary, Ukraine's government believes that Ukraine can still hold out, slowly losing lives and land but averting a entire defensive failure until conditions improve in its advantage.

Current Realities

Factually, there are no real preconditions for a truce. Now, personal considerations are coming into play: leadership ambitions to negotiate peace and secure international recognition, and Kyiv's double obstacles – on one hand, not to distance important partners, and on the other, to mobilize citizens around the national cause against any proposal Kyiv finds unworkable, so that their priority does not switch to domestic problems. And although their task will now be considerably more difficult after recent developments, it remains quite doubtful that this will alter their fundamental strategy.

These two forces are driving the talks.

Conclusion and Outlook

It took a just a single week to eliminate the 28 points of the latest plan. Assertive and inconsistent approach of the matter by Washington, resistance by Ukraine and the remaining European nations, along with pacifying measures of diplomats, and finally, recent disclosures, all served their function.

While new initiatives based on established approaches are approaching, Kyiv, London and other allied nations should draw one fundamental conclusion: Ukraine and Europe will only be able to fend off political attacks from Washington that are founded on Moscow's terms and demonstrate specific hesitation to modify developments, if they maintain solidarity and strengthen their defence capabilities at a considerably quicker tempo. If they do, neither political nor armed coercion will be able to overcome them. In the meantime, Ukraine's capability to repel nightly air assaults will, for the foreseeable future, mainly require ongoing international assistance.
